Section 139(9) โ€” your return is defective

A notice under section 139(9) says the return you filed is incomplete or internally inconsistent, and gives you a period โ€” usually 15 days โ€” to put it right. This one carries a consequence the others do not: an uncorrected defective return is treated as though it was never filed at all.

What makes a return defective

Using a form you were not entitled to โ€” ITR-1 where there were capital gains, ITR-4 where the presumptive limits were exceeded. Schedules left blank that the form required. Tax shown as payable but not actually paid. A claim to a deduction with none of the supporting detail the schedule asks for.

Note that a defective return is not the same as an incorrect one. The figures may be perfectly accurate; the return still fails because it was presented in a form the system cannot process.

An uncorrected defective return is treated as never filed โ€” including for your losses

This is the consequence that catches people. If the defect is not cured in time, the return is treated as though it was never filed. Every consequence of not filing then follows: the late fee under section 234F, interest under 234A, and โ€” the expensive one โ€” the loss of any capital or business loss you were carrying forward, because carry-forward requires a valid return filed by the due date. A fifteen-day window, quietly ignored, can cost eight years of loss set-off. If the deadline is tight, ask for an extension rather than letting it lapse.

Can I get more than 15 days?

You can request an extension through the portal, and it is usually better to ask than to miss the date.

Do I file a fresh return or correct the old one?

You respond to the notice and file a corrected return under section 139(9). It replaces the defective one and keeps the original filing date, which is why responding in time matters.

Why did I get this when my figures were right?

Almost certainly the form, not the figures. The commonest trigger is a return filed on a form your income did not qualify for.
